This Privacy Policy applies to all services operated by True Movement Virtual Inc. ("Company," "we," "us," or "our"), including the True Movement® website located at www.truemovement.ca ("Website") and the True Movement Virtual® mobile application ("App") (collectively referred to as the "Services"). This policy describes how we collect, use, store, and protect your personal information, and explains your privacy rights under applicable law.

This Privacy Policy complies with the Children's Online Privacy Protection Act (COPPA) in the United States, Canada's Personal Information Protection and Electronic Documents Act (PIPEDA), Quebec's Act Respecting the Protection of Personal Information in the Private Sector (Law 25), and other applicable privacy legislation in the United States and Canada.

By using our Services, you agree to the collection and use of your information in accordance with this Privacy Policy.

2. Interpretation and Definitions

2.1  Interpretation

Words with capitalized initial letters have meanings defined below. These definitions apply whether the terms appear in singular or plural form.

2.2  Definitions

Account: A unique account created for You to access our Services or parts of our Services.
App: The True Movement Virtual® mobile application.
Company: True Movement Virtual Inc., 5424 Thibault Wynd, Edmonton, AB T6R 3J1, Canada. Also referred to as "We", "Us", or "Our".
Country: Alberta, Canada.
Device: Any device that can access the Services, such as a smartphone, tablet, or computer.
Guardian: A parent or legal guardian of a Minor user who has provided consent for the Minor's use of the Services.
Minor: Any individual under the age of 18, or under the applicable age of majority in their jurisdiction.
Personal Data: Any information that relates to an identified or identifiable individual.
Services: Collectively, the True Movement® Website (www.truemovement.ca) and the True Movement Virtual® App.
Usage Data: Data collected automatically, either generated by use of the Services or from the Services infrastructure itself.
You: The individual accessing or using the Services, or the parent or legal guardian acting on behalf of a Minor user.

3. Data We Collect

3.1  Account Information

When you create an account on either the Website or the App, we collect:

  • First name and last name
  • Email address
  • Phone number
  • Birthdate (optional)
  • Address, province/state, postal/ZIP code, and city
  • Password (stored in encrypted form)

3.2  Fitness and Movement Data (App Only)

Through your use of the True Movement Virtual® App, we collect:

  • Workout impressions and unique session starts
  • Workout completions and completion rates
  • Repeat activity data
  • Streak data (current streak and longest streak)
  • Badges earned
  • The App does not collect GPS or location data, camera or microphone data, or data from wearable devices. Fitness and movement data is generated solely through your in-app activity.

3.3  Team and Organization Data (App Only)

If you are a member of a team or organization or family within the App, the following information may be visible to team/organization administrators:

  • Number of team members
  • Individual member profiles (name and account details)
  • Date each member joined
  • Current streak and longest streak
  • Number of badges earned

Platform management can access aggregated, general analytics across all users (such as total impressions, unique starters, completions, and completion rates) but does not access individual user-level data outside of team/organization contexts.

3.4  Usage Data

Usage Data is collected automatically when using our Services and may include:

  • Device Internet Protocol (IP) address
  • Browser type and version (Website)
  • Pages or screens visited and time spent
  • Mobile device type and unique device identifiers (App)
  • Mobile operating system (App)
  • Diagnostic and performance data

3.5  Push Notifications (App Only)

The True Movement Virtual® App may send push notifications to your device regarding updates, activity reminders, and service-related communications. You may opt out of push notifications at any time through your device settings or within the App's notification preferences.

3.6  Cookies and Tracking Technologies (Website Only)

Our Website uses cookies and similar tracking technologies to track activity and store certain information. We use the following types of cookies:

  • Necessary/Essential Cookies (Session): Required to provide core website functionality and authenticate users.
  • Cookie Acceptance Cookies (Persistent): Track whether you have accepted our cookie policy.
  • Functionality Cookies (Persistent): Remember your preferences such as login details and language settings.

3.7  Facebook Pixel (Website Only)

With your permission, our Website uses Facebook Pixel, a service of Meta Platforms Inc. This tool allows us to track user actions after clicking on a Facebook advertisement, measure the effectiveness of our advertising, and retarget users with relevant content on Facebook. 4. Children's Privacy and Youth Athlete Protections

True Movement Virtual® is designed in part for youth athletes. We take the privacy of Minor users extremely seriously and comply fully with COPPA (United States) and PIPEDA (Canada) as they apply to the collection of data from minors.

4.1  Users Under 13

We do not knowingly collect personal information from children under the age of 13 without verifiable parental or legal guardian consent. If you are a parent or guardian and believe your child under 13 has provided us with personal information without your consent, please contact us immediately at [email protected]. We will promptly delete that information from our servers.

4.2  Users Ages 13 to 17

Users between the ages of 13 and 17 may use our Services only with the express consent of a parent or legal guardian. By permitting a Minor to use the Services, the Guardian consents to the collection and use of the Minor's personal and fitness data as described in this Privacy Policy. We collect only the minimum data necessary for Minor accounts and do not use Minor user data for advertising or marketing purposes.

4.3  Guardian Rights

Parents and legal guardians of Minor users have the right to:

  • Review the personal information collected about their child
  • Request deletion of their child's personal information
  • Withdraw consent for further collection or use of their child's data

5. How We Use Your Data

We use the personal data we collect for the following purposes:

  • To provide, operate, and maintain our Services

  • To track and display your fitness progress, streaks, and badges within the App
  • To provide team and organization administrators with relevant member activity data

  • To comply with legal obligations and enforce our Terms of Service
  • To respond to your inquiries and support requests

6. How We Share Your Data

We do not sell your personal information. We may share your information in the following circumstances:
With Service Providers: Third-party companies that assist us in operating our Services, subject to confidentiality obligations.

  • With Team/Organization Administrators: Activity and progress data as described in Section 3.3, limited to your team or organization context.
  • With Platform Management: Aggregated, non-individual analytics data only.
  • For Business Transfers: In the event of a merger, acquisition, or asset sale, with prior notice to users.
  • For Legal Compliance: When required by law or valid requests from public authorities.
